By accessing and using BeyondWalls ("the Platform"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.

2. Description of Service

BeyondWalls is an AI-powered homeschool learning platform designed to help parents and educators track student progress, manage curriculum outcomes aligned with NESA (New South Wales Education Standards Authority), and generate learning activities and reports.

3. User Accounts

3.1 Eligibility and Age Requirements

• Minimum Age: You must be at least 18 years old to create an account
• Parent/Guardian Only: Only parents or legal guardians may create accounts and child profiles
• Accurate Information: You agree to provide accurate, current, and complete information during registration
• One Account Per Email: Each email address can only be associated with one account

3.2 Account Security

• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities under your account
• Notify us immediately of any unauthorised use: support@beyondwalls.app
• We are not liable for losses caused by unauthorised access due to your failure to secure your account

3.3 Parent/Guardian Responsibilities

As the account holder, you are responsible for:

• All child profiles created under your account
• All content, photos, and data uploaded to child profiles
• Ensuring uploaded content does not violate any laws or third-party rights
• Supervising your child's use of any reports, achievements, or app features
• Making educational decisions based on your own professional judgment, not solely on AI suggestions

4. AI-Generated Content

4.1 Nature of AI Services

BeyondWalls uses artificial intelligence to generate learning activity suggestions, outcome tagging, and educational content. While we strive for accuracy, AI-generated content may contain errors or inaccuracies.

4.2 User Responsibility

Users are responsible for reviewing and verifying all AI-generated content before relying on it. BeyondWalls is not liable for any decisions made based on AI-generated suggestions or content.

4.3 Educational Guidance

AI-generated content is provided as educational guidance only and should not replace professional educational advice or judgement.

5. User Content and Data

5.1 Ownership

You retain all rights to the educational content, student data, and learning logs you create on the Platform.

5.2 License to Use

By uploading content to the Platform, you grant BeyondWalls a limited license to store, process, and display your content solely for the purpose of providing our services to you.

5.3 Prohibited Content

You may not upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

6. Subscription and Billing

6.1 Free Trial

• New users may be eligible for a free trial period (if offered)
• Free trial duration will be specified at signup
• You can cancel anytime during the free trial without being charged
• If not cancelled, your subscription will automatically begin at the end of the trial period

6.2 Paid Subscriptions

• Subscription Plans: Monthly or annual plans (as offered)
• Payment: Processed securely through Stripe
• Automatic Renewal: Subscriptions renew automatically unless cancelled
• Price Changes: We may change subscription prices with 30 days' notice
• Taxes: You are responsible for any applicable taxes

6.3 Cancellation

• You can cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of your current billing period
• You will retain access until the end of the paid period
• No refunds for partial months or unused time

6.4 Refund Policy

• General Policy: No refunds for subscription payments
• Exceptions: Refunds may be issued at our sole discretion for:
• Technical issues preventing use of the platform
• Duplicate charges or billing errors
• Cases where we determine a refund is warranted
• Request Process: Email support@beyondwalls.app with your account details and reason
• Processing Time: Approved refunds processed within 7-10 business days

6.5 Payment Failures

If payment fails, we will attempt to contact you and retry payment. After multiple failures, your account may be suspended or downgraded to a free tier (if available). You remain responsible for outstanding charges.

7. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Please review our Privacy Policy to understand our practices.

8. Intellectual Property

8.1 Platform Ownership

BeyondWalls and its original content, features, and functionality are owned by BeyondWalls.app and are protected by international copyright, trademark, and other intellectual property laws.

8.2 NESA Curriculum

NESA curriculum outcomes and related educational content are owned by the NSW Education Standards Authority. BeyondWalls uses this content under appropriate educational licensing for the benefit of homeschooling families.

8.3 Trademarks

"BeyondWalls" and associated logos are trademarks of BeyondWalls.app. You may not use these trademarks without prior written permission.

9. Acceptable Use Policy

You agree NOT to:

• Use the platform for any illegal purpose or in violation of any laws
• Upload viruses, malware, or any harmful code
• Attempt to gain unauthorised access to our systems
• Scrape, data mine, or extract data using automated means
• Impersonate another person or entity
• Upload content that infringes intellectual property rights
• Upload offensive, abusive, or inappropriate content
• Share your account credentials with others
• Resell or redistribute our services

Violation of these terms may result in immediate account suspension or termination.

10. Limitation of Liability

To the fullest extent permitted by applicable law, BeyondWalls shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or use
• Any damages resulting from AI-generated content errors or inaccuracies
• Any damages resulting from unauthorized access to your account
• Any educational outcomes or compliance issues

Our total liability for any claims arising out of or relating to these Terms shall not exceed the amount you paid to BeyondWalls in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• Accuracy, reliability, or completeness of AI-generated content
• Uninterrupted or error-free operation of the Platform
• Educational outcomes or compliance with specific curriculum requirements

12. Termination

We reserve the right to terminate or suspend your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by email or through a notice on the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

14.2 Jurisdiction

Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

14.3 Dispute Resolution

Before initiating formal legal proceedings, we encourage you to contact us at support@beyondwalls.app to resolve disputes informally. Most issues can be resolved through discussion.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BeyondWalls regarding the use of the Platform.
